1. GENERAL

For the business relationship between the customer and the hairdressing salon Mia Capelli, Könneritzstraße 83, 04229 Leipzig, the following general terms and conditions (GTC) apply exclusively.

These conditions apply to all transactions, contracts and offers, as well as the services and the sale of products, which come about or are concluded between the hairdressing salon Mia Capelli and the customer. Exceptions that do not fall under the general terms and conditions require notification in writing. Deviating, conflicting or supplementary general terms and conditions, even if they are known, are not part of the contract unless their validity is expressly approved in writing.

 

2. SERVICES

Salon Mia Capelli carries out its services to the best of its knowledge and belief, as well as according to the latest industry standards. The customer will be informed of changes by Salon Mia Capelli before the start of the service.

 

3. DATES

Salon Mia Capelli mainly works on an appointment basis. Customers are offered appointments after specifying the services requested by the customer. These are then reserved with the date, time and the desired services.

This can be done in person, by telephone (0341 97541711) or using a corresponding booking tool on the homepage www.mia-capelli.de. As soon as the appointment is reserved, a service contract is created between the customer and Salon Mia Capelli.

 

For certain dates (e.g. wedding) the customer is required to pay in advance. This will be communicated to the customer when the appointment is made. These appointments are only optional until payment has been made and can be canceled and canceled by Salon Mia Capelli until full payment has been received.

 

Appointments that have not yet been paid for can be rescheduled with a notice period of 24 hours in advance. This must be done by phone or in writing.

 

If the customer is responsible for the agreed services (e.g. absenteeism or being late) or cannot be carried out completely due to lack of time, Salon Mia Capelli is entitled to withdraw from the contract and charge an appointment cancellation fee of 50% of the planned services to calculate. For services that have been paid for or in advance, the cancellation fee is 100%.

 

4. PRICES AND PAYMENT

The prices for services include the respective statutory VAT. Mia Capelli prices can be viewed publicly at any time at www.mia-capelli.de. For services that are not described in the price list, Salon Mia Capelli will be happy to provide information about the planned price in advance.

The indicated prices are minimum prices and may increase due to additional expenses (e.g. long or particularly thick hair, etc.) or the spontaneous booking of additional services. Unless paid in advance, invoice amounts are due immediately after the service has been provided and are to be paid in cash, by EC cash, credit card or voucher.

 

5. VOUCHERS

Paid vouchers / purchase vouchers:

Customers can purchase vouchers at Salon Mia Capelli. Paid vouchers can be redeemed like cash for the payment of all services and articles at Salon Mia Capelli.

Promotional and campaign vouchers and discounts:

Salon Mia Capelli sometimes offers customers promotional and promotional vouchers and discounts. These discounts can be linked to certain conditions (e.g. additional runs) or deadlines (e.g. limited in time). Salon Mia Capelli accepts advertising and campaign vouchers or grants discounts to customers without engagement. Thus, advertising and campaign vouchers as well as discounts can also be rejected and not accepted.

 

6. MINOR CUSTOMERS

Under the age of 16, Salon Mia Capelli can only provide color or bleaching services with the written consent of the legal guardian.

 

7. WARRANTY

If a defect appears, the customer has to inform Salon Mia Capelli immediately. It is only deemed to be immediate if it takes place within 5 days of the service or purchase at the latest.

Salon Mia Capelli then has a right to rectification. The choice of whether to repair or reimburse the costs lies solely with the salon Mia Capelli.

If Salon Mia Capelli offers a repair after a complaint has been made and the customer rejects this, the customer waives further claims for defects and repayment by refusing it. If the customer does not react to an offer for rectification within 48 hours, this is considered a rejection of the rectification.

 

There are no claims for defects in the case of only insignificant deviations from the agreed service or quality, in the case of only insignificant impairment of usability, in the case of natural wear and tear and damage resulting from incorrect or negligent treatment, excessive stress, unsuitable hair and skin care products by the customer or due to special influences arise.

 

If customers or third parties carry out repair work or changes, there are also no claims for defects for these and the resulting consequences.

 

8. WARRANTY

The customer receives a guarantee period of 5 days for the service provided.

This guarantee is void if the client does not use the products used in the salon. Products from well-known drugstore chains contain silicone and can remove the colour. 

 

9. PERSONAL INFORMATION AND PRIVACY

The customer assures to pass on to Salon Mia Capelli all personal data and information relevant for the professional implementation of the service.

This data is stored in electronic form in the customer file. Salon Mia Capelli undertakes to use this data only for the purpose of the service to be provided, taking into account the data protection clause, and not to pass the data on to third parties or outsiders without the written consent of the customer.

 

10. LIABILITY

Salon Mia Capelli assumes no liability for the customer's wardrobe, bags, luggage and valuables. Jewelry must be removed prior to treatment.

Salon Mia Capelli assumes no liability for customer clothing if it is damaged through the customer's fault, the same applies to any intolerances and allergies, whether known or unknown.

There is no liability for chemical, thermal, hair and skin cosmetic treatments expressly requested by the customer, as well as for all hairdressing measures.

In the case of circumstances for which Salon Mia Capelli is not responsible, e.g. illness or force majeure, such as power failure and the like, which partially or completely prevent the fulfillment of a customer order, no liability claim can be derived. Salon Mia Capelli also assumes no liability for postponements or delays in appointments for which Salon Mia Capelli is not responsible. If Salon Mia Capelli has to reschedule an appointment, the customer will be informed as soon as possible. The customer then has the option of agreeing on the new appointment with Salon Mia Capelli or canceling the appointment free of charge. If the customer has already paid for the appointment or has paid in full, all monies for unused services will be returned to the customer.

Salon Mia Capelli tries to plan the appointments in such a way that the appointment can start on time. Due to unforeseeable events, it can happen that the customer has to wait.

A claim for damages cannot be derived from this

 

11. DAMAGE AND THEFT

Salon Mia Capelli has the right to claim compensation for any damage caused by the customer. Shoplifting is reported immediately.

 

12. PICTURES

If Salon Mia Capelli publishes image examples in the salon or on the homepage, these are only examples. Even if the hairstyle or color is reworked on the customer, there may be deviations in the design, the shape and the effect of the design on the customer. The result may deviate from the image template shown. The copyright for the design remains with Salon Mia Capelli. Should the customer take photographs of the created design that are used for commercial purposes (Internet, publications, etc.), this requires a written declaration of consent from Salon Mia Capelli. Failure to do so may result in reasonable claims being made by Salon Mia Capelli.

 

13. CONDUCT

The customer undertakes to behave appropriately during the visit to the salon. If the customer continues to behave improperly even after a warning, Salon Mia Capelli has the right to expel the customer from the salon and, if necessary, to ban them from the premises.

 

14. FINAL CLAUSE

Should individual provisions of these general terms and conditions be void in whole or in part, the remaining provisions shall remain unaffected. The invalid provision will be replaced by one that is legal and comes closest to the meaning of the invalid provision.
